Penalties for Late Filing IRS HVUT Form 2290

July 1 is the first-day filers may e-file their IRS HVUT Form 2290 for the new tax year 2020-21.  The deadline for completing your 2290 submission without penalty is August 31. Anyone who files after this deadline, including those resubmitting previously rejected files, will be assessed a penalty on their truck taxes.  The best way to avoid these issues is to start filing early, but here is some more information for those who haven’t yet filed as the deadline approaches:

HVUT Penalties

If you fail to submit your Form 2290 Filing or HVUT payment before the August 31 deadline, the IRS will send you a notice with the penalty.  There are instances of the IRS waiving the penalty for extenuating circumstances, though this is rare and shouldn’t be relied upon. The IRS may also issue penalties for making false or fraudulent claims on returns such as misrepresenting the vehicle mileage or gross weight.

Penalties can be costly! The IRS will calculate penalties after reviewing possible reasons for delay. The normal penalty amount is 4.5% of the taxes due after the deadline. Thereafter, the penalty increases each month by 0.5% of the total tax due for up to 5 months. There is also a provision of additional interest of 0.54% per month on the total tax owed.

It is the form used to figure out and pay the tax due on motor vehicles operating on public highways with a taxable gross weight of 55,000 pounds or more. Verify the vehicle information entered. If "Taxable Gross Weight" is less than 55,000 lbs., then you do not need to file the Heavy Vehicle Use Tax and the site will not allow you to select the vehicle. Also check that you do not have a "Disposition Date" entered (see above).
